  1. ERRORS: Clerical or stenographic errors in quotations ,orders, acknowledgements, invoices or other documents are subject to correction. Telephone quotations are subject to correction prior to acceptance.
  2. ACCEPTANCE: All agreements, contracts and orders are subject to approval at our offices in Dover, NJ.
  3. FORCE MAJEURE.
  4. RETURNS: Products may not be returned for credit until our authorization has been obtained, and must be in new, unused, and resalable condition. Standard stock off-the-shelf items are returnable without a restocking charge.Any other items will be subject to a restocking charge that will vary depending upon the item. Custom fabricated and customer specified items are non-returnable All transportation costs must be prepaid.
  5. CLAIMS: Claims for corrections or deductions must be made within 10 days after receipt of goods.
  6. LIMITED WARRANTY: We warrant to the original purchaser for a period of one year from the date of invoice, or for such lesser period which equals the inherently shorter life of certain products, that products of our manufacture will be free from defects in material and workmanship, and will, at our option, repair or replace any product freeof charge following satisfactory proof of defect.This warranty shall be the extent of our liability with respect to our products. We do not guarantee glass products against breakage, clouding or the corrosive or erosive effects of any material or substance,as any glass product can break when subjected to thermal or mechanical stress. THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED. WE WILL NOT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY NATURE.
  7. PROPERTIES: Physical, chemical and mechanical properties are derived from data believed to be reliable, but these data do not imply fitness for particular purpose.
 
  1. DAMAGE IN TRANSIT: Claims for loss or damage must be made by the consignee, as title passes to the consignee upon delivery to the carrier.
  2. TAXES: Where the company is required to collect sales, use or excise taxes, such taxes will be added to invoice.
  3. PRODUCT CHANGES: Product designs, specifications, and continued availability are subject to change without notice.
  4. PRICE CHANGES: Changes in prices and/or discounts may be made at time of shipment after prior notification to the purchaser.
  5. TERMS: Net 30 days, FOB Dover, NJ
  6. SHIPMENT: Shipments will be made from Sparta, NJ.
  7. MINIMUM INVOICE: $30.00
  8. DEBIT MEMOS: John C. Ernst Company will not accept a debit memo as notification of any discrepant material.
  9. CANCELLATION CHARGES: May apply to any items that are on order with John C. Ernst Co. Inc. This amount may vary depending on the length of time the ordered items have been in production. For standard stock items there would not be any cancellation charges. For special manufactured items cancellation charges can be up to 100%.
  10. CHEMICAL COMPATIBILITY: We do not make chemical compatibility recommendations. Please review all materials of the quoted items for compatibility with the fluids in conjunction with the temperatures and pressures of the application beore placing an order for these items.
